1. Acceptance of Terms

By creating an account, downloading the application, or making a purchase on ECHOsenses, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. Description of Service

ECHOsenses is a desktop AI assistance application that provides real-time live transcription of audio you choose to capture, and surfaces AI-generated suggestions during conversations. The service is delivered as a desktop installer and a cloud-hosted backend that processes audio and AI requests.

3. License Grant

Subject to your compliance with these Terms and timely payment, ECHOsenses grants you a personal, non-exclusive, non-transferable, revocable license to install and use the application on devices you control, solely for your own use during the active term of your purchase.

4. Acceptable Use

You agree NOT to:

  • Resell, sublicense, or share your license key with another person or device beyond what is permitted.
  • Reverse engineer, decompile, or attempt to extract source code from the application.
  • Use ECHOsenses to record audio of any individual without obtaining all consent legally required in their jurisdiction.
  • Use the service for any unlawful purpose, fraud, or harassment.
  • Attempt to bypass authentication, license validation, or rate limits.
  • Use automated tools or scripts to abuse the AI or transcription endpoints.

Violation of these terms may result in immediate termination of your license without refund.

5. Recording Consent & Legal Compliance

You are solely responsible for complying with all recording, wiretap, privacy, and consent laws in your jurisdiction and the jurisdiction of every party whose voice may be captured. Many countries and US states require all-party consent. ECHOsenses is a tool; you are the operator. We are not liable for misuse.

5A. Intended Use, AI Limitations & User Acknowledgment

ECHOsenses is designed solely as an interview practice and confidence-building tool. By using the application — and explicitly each time you start a session — you confirm and accept the following:

  1. Training Purpose Only — The tool is meant for personal interview preparation, practice, and learning. It helps you build confidence by familiarizing yourself with common questions and structuring better answers.
  2. User Responsibility — You are solely responsible for how you use this software. ECHOsenses and its developers do not encourage, endorse, or support any form of misuse, cheating, fraud, or dishonest behavior during actual assessments, examinations, or live evaluations.
  3. Compliance with Third-Party Rules — It is your responsibility to ensure that your use of this tool complies with the policies, rules, and guidelines of your organization, institution, employer, or interviewing company, as well as all applicable laws.
  4. No Liability — ECHOsenses and its developers are not liable for any consequences, damages, detection, academic action, legal action, professional consequence, or loss arising from your use or misuse of this software. Use is entirely at your own risk.
  5. AI-Generated Content Limitations — Answers and suggestions generated by ECHOsenses are AI-powered and may not always be accurate, complete, or appropriate for your context. You must always rely on your own knowledge and judgment, and verify critical information independently.
  6. Stealth & Technical Limitations — While ECHOsenses uses advanced protections to hide its overlay from screen-sharing and recording tools, we cannot guarantee 100% invisibility in every scenario. Operating-system updates, drivers, antivirus software, screen recorders, remote-desktop tools, hardware-level capture devices, or other external software may bypass these protections. ECHOsenses and its developers are not responsible for any stealth failure, detection, or exposure caused by system, OS, hardware, or external software conflicts beyond our control.
  7. Referral Program Integrity — Referral rewards (30 extra subscription days per successful referral, capped at 4 referrals = +4 months) are credited only after the referred user's purchase clears the 48-hour refund window. Only paid, non-expired licenses qualify for extensions. Any attempt to abuse the referral system — including creating fake accounts, self-referrals, or refund cycling — will result in permanent forfeiture of all referral credits and may lead to account suspension or termination.

By starting any session, you re-affirm acceptance of the above conditions and release ECHOsenses and its developers from all liability for any consequences, damages, detection, academic or legal action, or loss arising from your use or misuse of this software. If you do not agree with these conditions, do not start a session.

6. Payments & Billing

Prices are listed on the website and inside the application at the time of purchase. Payments are processed by third-party payment processors. By purchasing, you authorize us (and our processors) to charge the agreed amount plus any applicable taxes.

Refunds are governed by our Refund Policy.

7. Account Security

You are responsible for safeguarding your account credentials. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that show signs of compromise or abuse.

8. Disclaimers

ECHOsenses is provided "as is" without warranty of any kind. AI-generated outputs may be inaccurate, incomplete, or unsuitable for your purpose. Do not rely on AI suggestions for safety-critical, legal, financial, or medical decisions. Transcription accuracy varies by audio quality, accent, and background noise.

9. Limitation of Liability

To the maximum extent permitted by law, ECHOsenses' total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 90 days preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Termination

You may stop using the service at any time. We may suspend or terminate your access for material breach of these Terms, fraud, abuse, or non-payment, with or without notice.

11. Changes to These Terms

We may revise these Terms periodically. The "Last updated" date reflects the most recent change. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be resolved in the competent courts located in Hyderabad, Telangana, India.
